Transactional taxes and fees in disputes For each used car dealer, the transaction tax is a thing they face every time they buy a used car. According to the general process, to buy a used car, you need to open a "secondary motor vehicle sales unified invoice" to the used car market. Second-hand car dealers can only get the invoice when they get the invoice, and the market is issuing this. When an invoice is issued, the used car dealer will be required to pay the transaction tax unilaterally.
"This is actually a market behavior. The used car trading market provides a one-stop service for handling the formalities. It is acceptable to charge the second-hand car dealers for a certain fee." It is understood that the current state of the second-hand car transaction tax is charged at 1.48% of the vehicle evaluation price. In fact, since 2005, this kind of high and low used car transaction tax has caused many protests from used car dealers. In this year, the “Regulations on the Management of Used Car Circulation” issued by the relevant departments clearly stipulated that “the cancellation of the transfer fee for used cars”, which makes there is no “second-hand car transaction tax” in the current laws of China, but so far Various fees are still disguised in the name of “used car transaction tax”, “management fee”, “assessment fee” and “transaction fee”.
This year, in the context of more and more cities in the country joining the restrictions, second-hand car dealers are experiencing unprecedented operational pressures. The competent department is duty-bound. In Lin Lin's view, the problem of second-hand car transaction tax has not been resolved for a long time. The main reason is the difficulty in obtaining evidence. "If you look at the bills alone, you can make a fake, and the tax is not statistical, because the tax department does not impose taxes on used cars, which makes the verification work difficult."
The other actual situation is that because the country does not have a complete and unified trading policy in the use of used car transactions, the management of the used car market in each place is basically independent, which is easy to appear in the local joint venture market with the qualification of used car trading market. Operating, leading to the interests of the market, the transaction tax is too high.
"At present, most of the used car market has the qualification for invoicing, and all kinds of interests are competing for this market." In the eyes of some institutions, transaction taxes are a huge income. Take Chengdu as an example. According to the statistics of Chengdu Commercial Daily, even in accordance with the lower standard of 400 vehicles per day and the average transaction service fee of 200 yuan per vehicle, the transaction fee for the four used car trading markets in Chengdu is still 80,000 per day. There are many yuan. At present, the tax on used car transactions in most cities in the country is above 200 yuan, and where this huge income eventually flows is still a mystery.
In July 2010, the Ministry of Commerce had to renovate the used car market, but there was no clear provision for charging. Lin Lin believes that the Ministry of Commerce should conduct market observation for three to five years, and then carry out standard unification, and the financial allocation will transform more than 100 used car markets nationwide. “For example, in Beijing, used car transactions are charged according to the amount of exhaust gas, mostly between 200 and 400 yuan. In principle, it does not exceed 1,000 yuan. However, some urban used car markets are privatized and difficult to manage.”
Lin Lin revealed that the Ministry of Commerce has recently taken action against second-hand car taxes and fees, and the second-hand car dealer protests that have appeared in various places are also reminding the relevant departments to take action. The latest situation is that the taxes on used car market in Erdos and Shijiazhuang have been lowered, and the amount of fees has been reduced from 200-3,000 yuan to 200 yuan. In the future, whether the "billing rights" of used car transaction taxes and fees can be released from the market, whether the national second-hand car transaction tax and fee standards can be unified, all parties in the industry are closely watching the situation.
