Pollution liability insurance system roadmap established

On February 18, the State Environmental Protection Administration (SEPA) announced that it had jointly issued the "Guidance Opinion on Environmental Pollution Liability Insurance" with the China Insurance Regulatory Commission. This marked the official launch of a roadmap to establish a structured environmental pollution liability insurance system in China. The initiative aims to address growing concerns over industrial pollution and its impact on public health and the environment. According to the announcement, this year’s pilot programs will focus on companies involved in the production, operation, storage, transportation, and use of hazardous chemicals, as well as oil, petrochemical, chemical firms, and those engaged in hazardous waste disposal—industries that are more prone to pollution incidents. Special attention will be given to enterprises that have been involved in major environmental accidents in recent years. This policy follows the earlier introduction of the “green credit” policy, making it the second major environmental economic measure introduced by the government. China is currently facing an increasing number of environmental pollution incidents. Among the 7,555 large-scale heavy chemical projects, 81% are located in ecologically sensitive areas such as river basins and densely populated regions. Additionally, 45% of these projects are classified as high-risk facilities, yet their preventive mechanisms remain inadequate, leading to frequent environmental accidents and serious consequences for public health and social stability. After an accident occurs, the lack of a clear mechanism for post-incident handling often results in companies failing to fulfill their obligations for compensation and environmental restoration. As a result, victims are unable to receive timely compensation, which can lead to social tensions and conflicts. Therefore, establishing an effective environmental pollution liability insurance system has become a pressing need. According to Pan Yue, deputy director of the SEPA, during the “Eleventh Five-Year Plan” period, the environmental protection department will work with the China Insurance Regulatory Commission to initially build an environmental pollution liability insurance system. Pilot projects will be launched in key industries and regions, with the goal of creating a risk-based directory of insurance companies and facilities, as well as setting standards for pollution damage compensation. By 2015, the system is expected to be largely improved and implemented nationwide. The government also plans to enhance various mechanisms, including risk assessment, loss evaluation, responsibility identification, accident management, and fund compensation, to ensure a more comprehensive and efficient response to environmental pollution incidents.
